Well That Was Unexpected
On appeal, the EFF’s suit against the government for warrantless Bush-era wiretapping (that congress has subsequently made legal) has been reinstated. Importantly, the court did not rule on the merits of the case, but neither did it skirt doing so by finding the EFF to have no standing.
If Obama doesn’t invoke the state secrets privilege, this could be a fun case to watch.
